Terms of Use

1. Definitions

We collect three types of information:

• “Website”: Refers to SmartFit and its subdomains.
• “User”: Any individual or entity accessing or using our Website or Services.
• “Services”: Includes Full-Body Workout, Accelerate Muscles Building, Increase Stamina, Enhance Fat Burn, Low-Impact Training, Speedy Recovery and more services offered by SmartFit.

2. User Obligations

By using our Website or Services, you agree to:

• Provide accurate and complete information when placing an order.
• Review and approve all proofs carefully before production begins.
• Make timely payments in accordance with agreed-upon terms.
• Refrain from submitting artwork or designs that infringe on third-party rights.

3. Orders and Production

• Minimum order quantities apply:
  • 12 pieces for embroidery
  • 24 pieces for screen printing
  • 50 pieces for patches
    
    
• Orders will not begin production until full or partial payment is received and proofs are approved.
• Once a design is approved, changes may require additional time and costs.

4. Pricing and Payment

• All prices are subject to change without notice.
• Payment is required before production begins, unless prior arrangements have been made.
• We accept Visa, Master Card & Discover. 

5. Artwork and Proofs

• Users are responsible for submitting correct and print-ready artwork.
• We will provide a digital proof or physical sample (if requested) for approval before production.
• Production will not commence until proof approval is confirmed.

6. Turnaround Time

• Standard turnaround is 7-10 business days after proof approval.-ready artwork.
• Rush services are available for an additional fee.
• Large or complex orders may require extended lead times.

7. Shipping and Pickup

• Orders may be picked up locally or shipped nationwide.
• Shipping fees will be outlined in your quote.
• SmartFit is not responsible for shipping delays caused by carriers.

8. Returns and Refunds

• Due to the custom nature of our products, all sales are final.
• We will replace or correct items with production defects or quality issues.
• Issues must be reported within 7 days of receiving your order.

9. Intellectual Property

By submitting artwork, you confirm that:

• You own the rights to the submitted designs or
• You have obtained proper authorization from the copyright holder.

We reserve the right to refuse production of copyrighted or offensive material.

10. Limitation of Liability

SmartFit is not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Missed deadlines due to incorrect information, delayed approvals, or third-party delays

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in accordance with these laws.
